These terms govern access to and use of the Biltmore Business Consulting website and financing services.

Section 01

Acceptance and eligibility

By accessing or using the Biltmore website, you agree to these Terms of Use and the linked Legal & Privacy Notice and Site & Financing Disclosures. If you do not agree, do not use the site.

You must be at least 18 years old and authorized to act for the business associated with any inquiry. The site is intended for lawful business-purpose financing inquiries, not consumer-purpose credit requests.

Section 02

Account access

Biltmore may modify, suspend, or discontinue website features or client access when reasonably necessary for security, maintenance, legal compliance, or business operations.

You may use the website only for lawful business-financing inquiries and may not interfere with its operation, attempt unauthorized access, or submit information you are not authorized to provide.

Section 03

Informational financing services

Biltmore provides commercial-financing consulting, request preparation, and referral coordination. Website content and preliminary program screens are informational only and do not create a lender-borrower, fiduciary, legal, tax, or accounting relationship.

Biltmore is not a lender and cannot issue a binding credit approval, denial, commitment, final rate, or final financing term. Independent financing sources make those decisions under their own policies and applicable law.

Section 04

Information and communications

Information you provide must be accurate, current, and submitted with authority. You may not submit confidential information belonging to another person or business without permission.

Submitting an inquiry or checking a consent box authorizes the communications described at that point. It does not authorize a lender submission, credit pull, identity verification, public-record check, or marketing communication unless separately and clearly disclosed.

Section 05

Prohibited use

You may use the site only for lawful purposes. You may not interfere with security, probe or bypass access controls, introduce malicious code, scrape the site at scale, impersonate another person, submit fraudulent information, misuse content, or use the site to violate law or third-party rights.

Biltmore may suspend access, preserve relevant records, and cooperate with lawful requests when it reasonably believes use is unauthorized, unsafe, fraudulent, or unlawful.

Section 06

Intellectual property

The site design, copy, graphics, branding, software, and other Biltmore-provided content are owned by Biltmore or its licensors and are protected by applicable intellectual-property laws.

Biltmore grants you a limited, revocable, nonexclusive, nontransferable right to use the site for its intended business purpose. No other license or right is granted by implication.

Section 07

External services and links

The site may link to websites or services operated by independent parties. Biltmore does not control their content, eligibility criteria, underwriting, availability, privacy practices, or security and is not responsible for their terms or actions to the extent permitted by law.

A link does not imply endorsement unless Biltmore expressly says so.

Section 08

No warranties or financing guarantee

To the fullest extent permitted by law, the site and services are provided on an as-is and as-available basis. Biltmore disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement where those disclaimers are legally permitted.

Biltmore does not guarantee uninterrupted access, error-free content, program availability, approval, funding, pricing, timing, savings, or any business outcome. Nothing on the site is a substitute for written final documents from an authorized financing source.

Section 09

Limitation of liability

To the fullest extent permitted by applicable law, Biltmore and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, lost opportunity, or business interruption arising from use of or inability to use the site.

Nothing in these terms excludes liability that cannot lawfully be excluded or limited. Any additional limitation, damages cap, indemnity, or dispute-resolution provision should be finalized by qualified counsel before public launch.

Section 10

Arizona law and general terms

Subject to any mandatory law that applies, these terms are governed by the laws of the State of Arizona without regard to conflict-of-law principles. Any venue provision for a public service should be approved by counsel before activation.

If a provision is held unenforceable, the remaining provisions remain in effect to the extent legally permitted. A failure to enforce a provision is not a waiver. Biltmore may update these terms by posting a revised effective date; continued use after an update constitutes acceptance where permitted by law.
